Milton's Planning Commission meets 6 p.m. Wednesday on 42 one-acre lots off King and Cox roads, 10 homes on Five Acre Road and a Crabapple preschool.
A plan to split 53.31 acres off King and Cox roads into 42 home lots goes before Milton’s Planning Commission on Wednesday. Each lot would be at least 1 acre. The land sits on the Roswell city line in south Milton.
The commission meets at 6 p.m. Wednesday, Oct. 28, in the Council Chambers at City Hall, 2006 Heritage Walk. People can attend or watch the meeting online. The city previewed the agenda in a news release on Tuesday.
What is on the agenda
| Item | Where | What is asked |
|---|---|---|
| Brookecrest, Pods C and D | 12400 King Road, 740 and 800 Cox Road and nearby land | 53.31 acres into 42 single-family lots of at least 1 acre |
| Harmony at Highway 9 | 265 Five Acre Road, near State Route 9 | 3.79 acres into 10 single-family lots |
| U26-02, The Wilds Early Learning Academy | 12457 Broadwell Road, Suite 103, in Crabapple | Use permit for a half-day preschool |
| RZ26-06 | Citywide, AG-1 land | Rule changes for large tracts, to be deferred |
The details come from the city’s agenda packet for the meeting.
Forty-two lots off King and Cox roads
The applicant is Toll Southeast LP Company Inc., according to the city’s staff report. The land is zoned AG-1, the city’s agricultural district, and lies in the Rural Milton overlay. Today it holds four single-family homes and scattered outbuildings, the report says.
The plan does not need a rezoning. The city said proposals that meet or exceed all zoning and subdivision rules are allowed “by right” in Milton. “And legally, the rights of property owners must be respected,” the release said.
City staff found that the preliminary plat meets the requirements of the applicable city codes, according to the report.
Ten homes on Five Acre Road
Epic Design & Build LLC wants to divide 3.79 acres at 265 Five Acre Road into 10 lots. That is 2.63 homes an acre, the packet says. The site is in Deerfield, near the intersection of State Route 9 and Five Acre Road.
The land is zoned T4 permissive under the Deerfield form-based code. The applicant’s plat puts the allowed density at five units an acre, or 18.95 units on this site.
Staff found the plat meets city code if one waiver is granted. The rule says no more than 20% of the lots in a development may face a civic space, here a 40-foot linear park. The community development director would have to approve that waiver, the report says.
A preschool for 20 children in Crabapple
The Wilds Early Learning Academy wants to run a half-day preschool in a 750-square-foot suite. The suite is part of a two-story, 12,064-square-foot commercial building on Broadwell Road, near the Alpharetta line.
City staff recommend approval with conditions. They include:
- no more than 20 children in each morning and each afternoon session
- hours from 7:45 a.m. to 4:15 p.m., Monday through Friday
- the preschool limited to the 750-square-foot space
The city’s Design Review Board supported the use at a courtesy review on Oct. 6, the report says. Nobody from the public came to the applicant’s community meetings on Sept. 29 and Oct. 14, according to the report. The City Council would make the final decision. The staff report names its Dec. 7 meeting.
Large-lot rules held back
The last item, RZ26-06, would change the rules on keeping large tracts of AG-1 land intact. The city said it will be deferred to a later meeting for more analysis and revisions.
It follows an earlier package. At an Oct. 14 special called meeting, the commission unanimously recommended approval of RZ26-05, the second phase of the AG-1 lot rules, with several wording changes, according to the action minutes in the packet. Our story on the large-lot and horse farm input session explains what RZ26-05 would do.
